1. Service Provider

This service is provided by CALLISTO AB , located at Medevigatan 5, 1301, S-113 61 Stockholm, Sweden.

CALLISTO AB operates multiple AI assistant brands. Your data is stored securely and is only accessible within askaieu.com. We do not share your data between brands without your explicit consent.

2. Acceptance of Terms

By creating an account, accessing, or using askaieu.com, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy , and our Data Processing Agreement (collectively, the "Agreement"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

askaieu.com provides an AI-powered conversational interface that allows users to interact with large language models hosted within the European Union. The Service includes:

• AI chat conversations with multiple AI models (Mistral, Qwen, and others)
• Web search integration for current information
• Optional chat history storage
• User account management

Important: The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Illegal Activities - Violate any applicable laws, regulations, or third-party rights
• Harmful Content - Generate, share, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Spam or Abuse - Send spam, chain letters, or engage in any form of automated abuse of the Service
• Security Violations - Attempt to gain unauthorized access to the Service, other users' accounts, or our systems; circumvent security measures; or interfere with the proper functioning of the Service
• Malicious Use - Use the Service to develop, test, or deploy malware, viruses, or any harmful code
• Impersonation - Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Intellectual Property Infringement - Infringe upon the intellectual property rights of others
• Data Scraping - Use automated means (bots, scrapers, crawlers) to access the Service without our explicit written permission
• Reverse Engineering - Reverse engineer, decompile, or disassemble any aspect of the Service

Enforcement: We reserve the right to investigate violations of this Acceptable Use Policy. Violations may result in immediate account suspension or termination, reporting to law enforcement, and legal action.

6. User Accounts and Security

6.1 Account Creation

6. Intellectual Property Rights

The Service, including its design, features, functionality, source code, and all content provided by us (excluding user-generated content), is owned by CALLISTO AB and is protected by international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

6.2 User-Generated Content

You retain ownership of any content you submit to the Service (your queries, prompts, and uploaded materials). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the Service.

Important:

• We do not claim ownership of your content or AI responses generated from your queries
• You are responsible for ensuring you have the right to submit any content to the Service
• Do not submit confidential, proprietary, or sensitive information unless you understand and accept the risks

6.3 AI-Generated Content Ownership

AI-generated responses are produced by third-party AI models (Mistral AI, Qwen, etc.). Ownership and usage rights of AI-generated content may be subject to those providers' terms. While we do not claim ownership of AI outputs, you acknowledge that:

• AI outputs may not be unique; the same or similar content may be generated for others
• AI outputs may incorporate training data patterns, which could raise copyright concerns
• You are responsible for ensuring your use of AI outputs complies with applicable laws

7. Privacy and Data Protection

Our collection, use, and protection of your personal data is governed by our Privacy Policy and Data Processing Agreement . By using the Service, you consent to our data practices as described in those documents.

Key points:

• All data is stored and processed within the European Union
• We sanitize logs to remove personally identifiable information (PII)
• You have the right to access, correct, or delete your personal data
• Optional chat history can be deleted at any time through your account settings

8. Service Availability and Maintenance

8.1 No Uptime Guarantee

We do not guarantee that the Service will be available at all times or that it will be uninterrupted, timely, secure, or error-free. The Service may be unavailable due to:

• Scheduled or emergency maintenance
• Third-party service provider outages (hosting, AI providers, etc.)
• Network or infrastructure failures
• Security incidents or attacks
• Force majeure events

8.2 Maintenance Windows

We may perform scheduled maintenance from time to time. While we will attempt to provide advance notice of scheduled maintenance, we are not obligated to do so. During maintenance, the Service may be partially or fully unavailable.

8.3 No Compensation for Downtime

We are not liable for any downtime, and you are not entitled to any refunds, credits, or compensation for service unavailability (applicable if/when paid tiers are introduced).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND SUBJECT TO MANDATORY PROVISIONS OF EU LAW:

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, reliable, or suitable for any purpose
• Defects or errors will be corrected

9.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

• €100 (one hundred euros), OR
• The total amount paid by you to us (if any) in the 12 months preceding the event giving rise to liability

9.3 Exclusion of Consequential Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or information (except as required by GDPR)
• Business interruption
• Loss of goodwill or reputation
• Cost of substitute services

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).

9.4 Exceptions to Limitations

Nothing in these Terms shall limit our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Gross negligence or willful misconduct
• Violations of your rights under the GDPR where such violations result from our intentional or grossly negligent conduct
• Any other liability that cannot be limited under applicable EU or Swedish law

You agree to indemnify, defend, and hold harmless CALLISTO AB, its affiliates, officers, directors, employees, agents, and service providers from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms or our Acceptable Use Policy
• Your violation of any applicable laws or third-party rights
• Content you submit to the Service
• Your reliance on AI-generated content
• Decisions made based on AI outputs

11. Third-Party Services and Links

The Service may integrate with or contain links to third-party services, websites, or content. We are not responsible for:

• The availability, accuracy, or reliability of third-party services
• The content, privacy practices, or terms of service of third-party sites
• Any damages arising from your use of third-party services

Third-Party AI Providers:

We use AI models provided by Mistral AI (France), Alibaba Cloud (Qwen models), and other providers. Your use of these models through our Service is also subject to their respective terms and policies.

12. Modifications to Terms and Service

12.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email notification to your registered email address (for material changes)

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.

12.2 Changes to Service

We reserve the right to:

• Add, modify, or remove features of the Service
• Change or discontinue AI models
• Introduce new pricing or subscription tiers
• Discontinue the Service entirely

We will provide reasonable notice of material changes where feasible.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sweden. However, nothing in this section shall prevent us from seeking injunctive relief in any jurisdiction.

13.3 Informal Resolution

Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and CALLISTO AB regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of CALLISTO AB.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

14.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, pandemics, network infrastructure failures, strikes, or third-party service provider failures.

14.6 Survival

The following sections shall survive termination of these Terms: Intellectual Property Rights, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and General Provisions.
